The two co-founders of the infamous torrent site The Pirate Bay Peter Sunde and Fredrik Neij are aiming for a hearing at the European Court of Human Rights (ECHR) in June 20, 2012 in order to appeal the verdict, which was passed in 2009.
Two other co-founders of the torrent site Gottfrid Svartholm Varg and Carl Lundstroem didn’t provide any information about their intent to appeal.
In 2009 the founders of The Pirate Bay have been found guilty of copyright infringement and sentenced to fines and imprisonment.
The appeal with the ECHR is not the first one. Earlier founders of the torrent site made several attempts through other Swedish courts. The current appeal is based on the same arguments that the statements in the other judicial institutions.
According to Neij’s lawyer Jonas Nilsson, Article 10 of the European Convention on Human Rights guarantees citizens of Sweden the freedom to receive and impart information. The article applies to the torrent site as it only provides torrent trackers, but not products which are protected by copyright.
The process in the European Court of Human Rights can last for 4-5 years.
